Linda Dale Hoffa Wins Significant US Supreme Court Victory

Linda Dale Hoffa secured a significant Supreme Court Victory for her court-appointed client, resulting in her client’s immediate release from prison.

On June 27, 2022, the Supreme Court granted the petition for certiorari Ms. Hoffa filed in Walker v. United States,  No. 21-102. The Supreme Court vacated Mr. Walker’s judgment of conviction and remanded her client’s case to the United States Court of Appeals for the Third Circuit for further consideration in light of last week’s Supreme Court decision in United States v. Taylor, 596 U. S. ___ (2022).  Taylor held that attempted Hobbs Act robbery is not a crime of violence under the categorical approach for a conviction under 18 USC § 924(c) (which imposes a mandatory minimum consecutive sentence of 5 years for the use of a weapon in connection with a violent crime). And in light of the Taylor ruling, Ms. Hoffa obtained a bail order for Mr. Walker’s immediate release from Bureau of Prison’s custody.

The appeal was handled by Linda Dale Hoffa, Chair of Dilworth’s Criminal Law Group, and she was assisted by associates Patrick Hamlet and David Rodkey.
