Overview

Ben represents and counsels clients on complex labor and employment matters affecting a broad array of industries.  Ben has significant experience working with clients throughout every stage of the legal process, from legal counseling to appearing before a jury in court.  Having represented both employees and employers, Ben routinely applies his holistic insight to address individualized client matters.  Ben excels at counseling clients in labor and employment matters and at communicating complex legal concepts to ensure that clients understand the legal process from beginning to end.  Ben has successfully represented clients before state and federal courts and numerous administrative agencies in Pennsylvania and New Jersey.

Representative Experience

  • Served as first chair in a multiple plaintiff federal jury trial involving claims against a recycling industry employer of discrimination and retaliation claims arising under Title VII of the Civil Rights Act of 1964 (“Title VII”), the Age Discrimination in Employment Act (“ADEA”), and Section 1981 of the Civil Rights Act of 1866 (“Section 1981”)
  • Acted as first chair in a federal jury trial involving claims of disability discrimination and retaliation claims arising under the Americans with Disabilities Act (“ADA”) and the Pennsylvania Human Relations Act (“PHRA”) brought by an employee in the commercial gaming industry
  • Served as lead counsel for a municipal employer in a labor arbitration hearing concerning a class action grievance arising under the parties’ collective bargaining agreement brought by more than a dozen correctional staff implicated in the escape of a prison inmate
  • Obtained summary judgment on behalf of a public employer and numerous management personnel in the municipality’s police department in a case concerning claims of First Amendment retaliation brought under the Civil Rights Act of 1871 (“Section 1983”) that was affirmed on appeal by the Third Circuit Court of Appeals
  • Secured summary judgment on behalf of a municipal employer in a matter involving a claim of age discrimination for the denial of a promotion in the municipal employer’s information technology department
  • Achieved summary judgment in favor of a municipality in a case brought by a correctional industries employee concerning claims of racial discrimination, hostile work environment, and retaliation arising under Title VII of the Civil Rights Act of 1964 (“Title VII”) and the Pennsylvania Human Relations Act (“PHRA”) that was affirmed on appeal by the Third Circuit Court of Appeals
  • Represented clients in matters involving employees with medical marijuana certifications and the requirements of the Pennsylvania Medical Marijuana Act (“PMMA”) in a variety of industries, including healthcare, automotive, manufacturing, transportation, technology, and security
  • Handled collective and individual action wage claims concerning unpaid overtime, minimum wage, and contractual wage disputes arising under the Fair Labor Standards Act (“FLSA”), Pennsylvania Minimum Wage Act (“PMWA”), Pennsylvania Wage Payment and Collection Law (“WPCL”), New Jersey Wage and Hour Law (“NJWHL”), and the New Jersey Wage Payment Law (“NJWPL”) in state and federal courts in Pennsylvania and New Jersey
  • Achieved favorable decision after a hearing before an Administrative Law Judge (“ALJ”) for a client in the manufacturing industry in an unfair labor practice matter involving a claim of retaliation for engaging in concerted protected activity for reporting COVID-19 protocol concerns before the National Labor Relations Board (“NLRB”)
  • Served as co-counsel in bench trial on behalf of a client in the health care industry in a matter involving a wrongful termination claim for whistleblowing activity arising under the Pennsylvania Whistleblower Law (“PWL”)
