Insurance Coverage

Dilworth Paxson's Insurance Coverage Group handles litigation in administrative forums and courts and insurance coverage questions. As a rule, the Group generally does not handle claims defense litigation.

Insurance Coverage Group lawyers have represented numerous insurers in various litigation matters. We have decades of experience representing insurers in direct actions brought by insureds, including bad faith claims and have assisted in coverage dispute matters involving other primary insurers, re-insurers and excess carriers.

We have represented various domestic and international insurers in disputes involving errors and omissions and general liability policies. This litigation experience includes a jury trial for bad faith and numerous declaratory judgment and breach of contract actions. In addition, we counsel insurers on coverage issues arising from the defense of third party claims against insured.

Some of its representations include:

  • Represented Certain Underwriters at Lloyds and Companies in an action brought by an insured for insurance coverage and bad faith, and in 2006 received a defense verdict after a two-week jury trial in the Court of Common Pleas of Philadelphia, Commerce Court Division.
  • Represented two insurers in the asbestos federal class action Georgine v. Amchem Products, et al, and collateral litigation from November 1993 until June 2005.
