Mr. Foret represents clients in protecting, leveraging, policing, and enforcing domestic and international intellectual property rights in various venues across a wide variety of sectors, including data systems technology, biotechnology, stem cell technology, sporting goods, business methods, and telecommunications industries. He provides representation for clients seeking to procure patent and trademark rights with the U.S. Patent and Trademark Office and in foreign patent and trademark offices with a network of associate foreign law firms throughout the world. Mr. Foret is involved in helping clients leverage established and emerging technology and branding rights through licensing, joint development, and research agreements.

In areas of litigation, Mr. Foret has been involved in representing clients in patent infringement litigation in federal courts and AAA arbitration, the filing of amicus briefs with the Federal Circuit and the U.S. Supreme Court in the In re Bilski case, in arguing domain name disputes before the National Arbitration Forum, and advocating for trademark rights in opposition and cancellation matters pending before the Trademark Trial and Appeal Board.

Representative Experience

  • Provided intellectual property counseling to a stem cell and cord blood preservation company regarding patent searching, procurement of domestic and international patent and trademark rights, and leveraging of intellectual property rights through licensing, collaborative research, service and distribution agreements, manufacturing agreements, and joint development agreements.
  • Provides trademark and service mark counseling regarding procuring, policing, and leveraging trademark rights to clients in industries including insurance, telecommunications, transportation and logistics, information technology, environmental testing, beverages, cigars and tobacco, biotechnology, news and newspapers, financial and investments, military and defense contractors, and sporting goods
  • Provides patent counseling through representation of inventors and corporations as a patent attorney in drafting, filing, and prosecuting patent applications before the U.S. Patent and Trademark Office
  • Successfully defended a data systems company in a patent infringement action initially brought in Federal Court and later litigated through a AAA Arbitration proceeding
  • Actively and effectively policed trademark and service mark rights for clients
  • Successfully policed and enforced trademark rights through several Uniform Domain Name Dispute Resolution Policy actions for a leading U.S.-based financial institution
  • Represented financial firms as amicus curiae parties in In re Seagate Technology LLC and In re Bilski cases before the Court of Appeals for the Federal Circuit
  • Represented a foreign telecommunications company as an amicus curiae party in In re Bilski before the U.S. Supreme Court
  • Collaborated with a Canadian IP firm in successfully defending an opposition filed in the Canadian Intellectual Property Office
  • Represented slot base manufacturers in bringing and settling a patent infringement action in Federal Court
  • Successfully represented insurance company in asserting rights in a co-pending opposition and cancellation proceeding before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office
  • Successfully petitioned the U.S. Patent and Trademark Office to accept a utility application into its highly selective Accelerated Examination Program
