Joseph Freudenberg is Chair of the Environmental Practice at Dilworth Paxson. He focuses his practice on complex environmental issues in business transactions, environmental compliance and enforcement; Brownfields and site remediation, and corporate environmental management. He has represented clients in environmental cleanup projects under numerous federal and state programs, including Superfund, RCRA Corrective Action, Pennsylvania’s Land Recycling Program (Act 2) and New Jersey’s Site Remediation Program.

Prior to joining Dilworth Paxson, Joe was Senior Counsel at Sunoco, where his primary responsibilities were legal matters relating to environmental contamination and remediation. Before attending law school, Joe served as a Site Remediation Project Manager for the New Jersey Department of Environmental Protection.

Representative Experience

  • Served as in-house counsel in toxic tort litigation relating to MTBE-contamination in numerous private potable wells in a town with limited municipal water supply availability.
  • Counseled petroleum company with respect to underground storage tank release located in the vicinity of a municipal water well impacted by MTBE.
  • Counseled petroleum company with respect to releases of gasoline with known or potential impacts to drinking water wells at numerous locations.
  • Advised client in connection with the acquisition of manufacturing facility that was developed on a former coke plant and subject to on-going oversight by the Pennsylvania DEP.
  • Represented manufacturing company in connection with the complex remediation of an industrial facility located in Southeaster Pennsylvania under a Consent Order and Agreement with the Pennsylvania Department of Environmental Protection (“DEP”), including United States Environmental Protection Agency (“EPA”) involvement through the DEP/EPA One Cleanup Program.  Advised client on the application of site specific remediation standards and utilization of environmental covenants under the Pennsylvania Uniform Environmental Covenants Act (“UECA”).
  • Advised client in connection with issues associated with remediation of multiple underground storage tank sites throughout Pennsylvania. Issues addressed included application of statewide, site specific and background cleanup standards, applicability of UECA obligations to previously remediated sites, drafting of UECA environmental covenants, and scope of liability releases.
  • Represented responsible party in connection with claims by developer of a mixed used project in Philadelphia in connection with the investigation and remediation of historic environmental contamination. Negotiated cost-effective resolution for the client through development of a cost-effective remediation plan that complied with Pennsylvania requirements.
