Brett Wiltsey has a diverse and multi-faceted practice throughout the Philadelphia region. He regularly represents regional and national financial institutions in litigation concerning Articles 3, 4 and 4A of the Uniform Commercial Code, Federal Regulation E, consumer fraud, fraudulent endorsements and similar litigation matters, as well as workout, bankruptcy, and the drafting of loan and loan modification documents. His bankruptcy practice also includes several appointments as special bankruptcy counsel to municipalities throughout the region.

In addition, Brett represents middle market and emerging growth companies as their general outside counsel. This representation involves assisting these companies with their formation documents, shareholder and operating agreements, litigation (commercial disputes, consumer fraud, and employment), real estate and land use needs, employment litigation and counseling, non-compete agreements, and merger and acquisitions.

Further, Brett represents municipalities and related governmental entities throughout the State of New Jersey as special counsel focusing on litigation, real estate, redevelopment, and associated issues. Brett's diverse practice allows for focused and effective guidance to both his private and public clients.

Representative Experience

  • Represented a large financial institution in a multi-state work-out with regard to a large regional developer.
  • Represented national corporations defending them in class action and consumer fraud claims.
  • Represented a large financial institution in the sale of a multi-million dollar hotel through a third-party plan filed by the institution in bankruptcy proceeding.
  • Represented multiple contractors in defense of preference actions brought by the Bankruptcy Trustee in the Kara Homes, Inc. bankruptcy case.
  • Represented a financial institution in prosecuting fraudulent endorsement claims.
  • Represented clients in the purchase and sale of real estate and liquor license.
  • Represented general contractor in negotiating contract to build an $8 million hotel and, after the owners defaulted, negotiated with the lenders to ensure financing was available to complete project to ensure client's contract was satisfied in full.
