Associate, Intellectual Property Group. Mr. Foret has an extensive background with the procurement, perfection, enforcement and leveraging of domestic and international patents, trademarks, copyrights and trade secrets in a wide variety of industries. His experience includes transactional practice in areas of due diligence, licensing of technology and transferring ownership of intellectual property. He also handles patent and trademark litigation in federal court, administrative actions in opposition and cancellation proceedings before the Trademark Trial and Appeal Board, and domain name disputes before ICANN-approved arbitration forums.
Mr. Foret's patent practice experience includes preparation and prosecution of United States provisional, utility and design applications, PCT international applications, development of global patent procurement and enforcement strategies, and preparation of patentability and validity opinions. The representative arts in which Mr. Foret has exposure include the areas of medical devices, biotechnology, pharmaceuticals, and other novel inventions. Mr. Foret's trademark practice experience includes trademark and trade dress availability searching as well as drafting related availability opinions, prosecution of United States and Madrid Protocol applications, and maintenance and enforcement of trademark registrations. Mr. Foret's copyright practice experience includes developing strategies for securing and perfecting protection of various copyrightable works and enforcing such rights.
REPRESENTATIVE MATTERS:
Provide intellectual property counseling to a stem cell and cord blood preservation company regarding patent searching, procurement of domestic and international patent and trademark rights, and leveraging of intellectual property rights through licensing and collaborative research
Provide trademark and service mark counseling regarding procuring, policing, and leveraging patent and/or trademark rights to an insurance company, transportation and logistics company, environmental testing products and service company, beverage company, and semiconductor cleaning apparatus company
Successfully settled a patent infringement action in Federal Court for a data systems company
Successfully policed and enforced trademark rights through several Uniform Domain Name Dispute Resolution Policy actions to a leading U.S.-based financial institution
Represented financial firms as amicus curiae parties in In re Seagate Technology LLC and In re Bilski cases before the Court of Appeals for the Federal Circuit
Collaborated with Canadian IP firm in successfully defending an opposition filed in the Canadian Intellectual Property Office- Duquesne University School of Law, Pittsburgh, Pennsylvania,
